Volodymyr Zhukovskyy pushing for bail as New Hampshire motorcycle crash case drags on
As Volodymyr Zhukovskyy awaits his day in court, his lawyers argue he should at least be offered a bail hearing.
In what looks like a sneak-peek into the noted case, the truck driver’s legal team argues some early statements in the horrific New Hampshire motorcycle crash that killed seven are wrong.
“The court erred in denying Zhukovskyy’s requests for an evidentiary hearing on the issue of bail. Because there are disputed issues of fact that bear on the issue of dangerousness, this court must remand for an evidentiary hearing,” wrote Christopher Johnson.
Zhukovskyy is accused of killing seven motorcyclists in a 2019 crash in Randolph, N.H.
He has pleaded not guilty to charges of reckless conduct and seven counts of manslaughter. He has also been charged with 14 counts of negligent homicide — seven charging him with causing the collision that led to the death of each victim, and seven alleging he was under the influence of a drug during the crash that led to their deaths.
His lawyer states in a new filing Monday that New Hampshire “obtained new manslaughter and negligent homicide indictments omitting the allegation that Zhukovskyy crossed into the oncoming traffic lane.”
That, the lawyer states, is reason enough to allow the Springfield 25-year-old to have a shot at posting bail.
“If released, Zhukovskyy could be supervised … and subjected to conditions such as that he not drive nor consume drugs or alcohol,” his lawyer adds. A November trial is possible.
